What If The Acts Of Another Have Contributed To The Issues?

When considering if an act has been negligent or not, it is also important to assess whether another party has contributed to that act. ie If a party is required to carry out checks before works were undertaken and they failed to do so, has that act, or failure to act, contributed to the breach and/ or loss in any way?

Where another party has acted in a way which has contributed to an issue or loss, this is known as contributory negligence. This is often an important point to consider, especially where several parties are involved in the same projects contributing to the same end goal, and this may reduce or even completely remove the liability of another party.
